Terms and conditions

1. Introduction:

1.1. This platform is made available to organisations and businesses involved in construction, including employers, colleges and schools ("Organisations") and to individuals including new entrants into construction or individuals looking for a career change ("Work Seeker(s)") (collectively  "You" "Your" or "User(s)") through the Website and portal, and any other sites owned and operated by us or third parties (the "Platform").

1.2. By using the Platform, You are confirming that You understand these terms and conditions (the "Terms") and that You will comply with them including: our privacy policy which can be found (https://www.citb.co.uk/utility-links/privacy-policy-cookies/), which sets out the terms on which we process any personal data we collect from You, or that You provide to us; and•  the terms and conditions and any terms and conditions of use of any third-party service providers.

1.3. If You do not agree to all of the Terms, You must not use the Platform.

1.4. You are responsible for ensuring that all persons who access the Platform through Your device(s) are aware of these Terms, and that they comply with them.

1.5. We do not warrant that the Platform will be error-free and the service is furnished "as is" without warranty of any kind, including that the service is fit for any particular purpose. The User is solely responsible for determining the appropriateness of using the Platform and assumes all risks associated with the use of it, including but not limited to, the risks of program errors, damage to or loss of data, programs or equipment, and unavailability or interruption of operations.

1.6. We update the Terms from time to time. If we do so, You will be deemed to have accepted any changes to the Terms when You next use the Platform.

1.7. We may update and change the Platform from time to time at our sole discretion.

1.8. We do not guarantee that the Platform, or any content on it, will always be available, uninterrupted or suitable for viewing on Your computer or other device. We may suspend or withdraw or restrict the availability of all or any part of the Platform for business and operational reasons. We will try, but cannot guarantee, to give You reasonable notice of any suspension or withdrawal.

2. Creating an Account

2.1. Each User will be required to register on the Platform and open an account ("Account") in order to use the Platform.

2.2. We will provide You with a username and a password to create and activate Your Account. Once You have logged in to Your Account for the first time, You must change Your password to a strong password that You will remember. You are responsible for all of the activity that occurs in association with Your Account.

2.3. If You are provided with a password or any other piece of information as part of our security procedures, You must treat such inform
ation as confidential. You must not disclose it to any third party.

2.4. To create a profile and open an Account on this Platform, You must be eligible to apply for jobs within the UK.

2.5. The Platform may be used by any person who has opened an account.

2.6. We reserve the right to disable Your Account at any time if, at our sole discretion, we conclude that You have failed to comply with any of the provisions of these Terms.

3. Summary of Service  

3.1. Our Platform is designed as a "jobs board" to enable:· Organisations to share their details and information on job vacancies for viewing by Work Seekers; and · Work Seekers to share their details including their CVs for viewing by Organisations. (collectively the "Service(s)")

3.2. The Platform does not identify any User by name or disclose their contact details unless this information is voluntarily provided by You (on registration or on a later edit); You may amend update or add to Your details on the Platform by clicking on the appropriate Edit button.

3.3. A Recruiter or a Work Seeker make contact by clicking on the relevant button and the Platform  will automatically generate an email to the other User.  The Platform provides no service other than providing the facility referred to above.

3.4. Organisations and Work Seekers must conduct any subsequent communications or discussions directly between themselves.  Work Seekers may choose, at their discretion, whether to respond to emails from Organisations.

3.5. The information and services available on and through the Platform are provided for the sole purpose of providing the Services. Users may only use, print or download information from the Platform for such purposes and for no other purpose.

4. Data Protection

4.1. We process information about You in accordance with our Privacy Policy which can be found (https://www.citb.co.uk/utility-links/privacy-policy-cookies/)

5. Acceptable Use

5.1. The User agrees to use the Platform in accordance with all applicable laws and regulations. You must not use the Platform for unlawful purposes including, but not limited to:
• using the Platform for any illegal purpose or in violation of any local, state, national, or international law;
• posting or transmitting any content that infringes on the intellectual property rights or privacy rights of others;
• attempting to gain unauthorized access to the Platform, any other accounts, or any computer systems;
• interfering with the proper functioning of the software, including the use of viruses, malware, or any other disruptive code;
• engaging in fraudulent activities, including impersonation or misrepresentation of affiliation with any entity;
• sending or uploading any material that contains viruses, spyware, any other harmful or malicious content designed to cause damage, disruption, or compromise the Platform or any computer software or hardware;
• attempting to disrupt or interfere with the Platform or another person's use of the Platform in any way or use the Platform to disrupt or interfere with our network;
• upload any content to the Platform that:o is inaccurate or defamatory; contains material that is obscene, offensive, hateful or inflammatory; promotes sexually explicit material, violence or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; o facilitates illegal activity;  depicts sexually explicit images;  promotes unlawful violence.

5.2. We reserve the right, without liability or prejudice, to disable Your access to the Platform if there is any breach of the provisions of this clause.

5.3. You must not:
• post any copies or downloads of materials which come from the Platform on any networked computer, or publish them or make any statements or undertake any actions in relation to them;
• modify, reproduce, duplicate, copy or re-sell any part of the Platform or copies (digital or paper) of any materials You have printed off from the Platform;
• remove any indications of ownership from any material which came from the Platform or claim it as Your own or as that of any other organisation or person.

5.4. If You use the Platform to upload or share any content in breach of this clause 5, we will flag such content as inappropriate and remove it from the Platform and reserve the right to remove You from the Platform.

6. Intellectual Property

6.1. You acknowledge and agree that we or our third-party suppliers own all Intellectual Property Rights in the Platform and that use of the Platform does not grant You any rights to, under or in, any patents, copyright, database right, trade secrets, trade names, trade-marks (whether registered or unregistered), or any other proprietary right in the Platform and/or any materials on the Platform.

7. Job Search details, CVs and job advertisements (the "Documentation")

7.1. Organisations and Work Seekers need to be aware that our Platform is a 'jobs board'" which operates as a location only and relies on Work Seekers and Organisations to make direct contact.

7.2. None of the Documentation shared on the platform is reviewed by us. We accept no responsibility or liability for the contents of the Documentation and expect Users to carry out such verification as they consider appropriate. The use of the Documentation is at the User's sole risk.

8. Limitation of liability

8.1. Nothing in these Terms will:· limit or exclude any liability for death or personal injury resulting from negligence;· limit or exclude any liability for fraud or fraudulent misrepresentation;· limit any liabilities in any way that is not permitted under applicable law; or· exclude any liabilities that may not be excluded under applicable law.

8.2. We make no representations or warranties, express or implied, that the content on the Platform is accurate, complete or up to date.

8.3. Although we make reasonable efforts to ensure that the Platform is a secure environment, we do not guarantee that the Platform will be secure or free from Computer Viruses. We shall not be liable for any loss or damage You may suffer as a result of a Computer Virus or harmful content transmitted via the Platform.

8.4. Subject to clause 8.1 above, we will not be liable to You for any loss or damage arising from their use of the Platform including any third party for any special, incidental, indirect, punitive or exemplary or consequential damages, or damages for loss of business, loss of profits, business interruption, or loss of business information arising out of the use of or the inability to use the Platform or for any claim by any other party.

8.5. You agree to indemnify us and keep us indemnified against all costs, expenses, claims, losses, liabilities or proceedings arising from use or misuse by You of the Platform. You must notify us immediately if anyone makes or threatens to make any claim against You relating to Your use of the Platform.

9. Termination

9.1. We may terminate Your registration and/or deny You access to the Platform or any part of it at any time in our absolute discretion and without any explanation or notification.

10. Variations to the Terms

10.1. These Terms may be varied at any time at our sole discretion. You will be deemed to have accepted any changes to the Terms when You next use the Platform. If any provision or part-provision of these Terms becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of the Terms.

11. Governing law

11.1. These Terms shall be governed by and construed in accordance with, and subject to the exclusive jurisdiction of, the courts of England and Wales.
